Terms of use
1 - APPLICABILITY
1.1. These Terms of Use govern the conditions applicable to the BUYER who purchases PRODUCTS or SERVICES from ARQBASE, developed or made available by GORDEEFF ARQUITETURA E TREINAMENTOS LTDA, registered under CNPJ nº 33.449.044/0001-52, headquartered in Campinas, at Avenida José Bonifácio Coutinho Nogueira 214, Room 636, Campinas – SP, ZIP Code 13091-611.
1.2. For the purposes of this document, the term BUYER encompasses all individuals who purchase PRODUCTS or SERVICES from ARQBASE.
1.3. The term ARQBASE PRODUCTS or SERVICES refers to all items developed by GORDEEFF ARQUITETURA E TREINAMENTOS LTDA.
1.4. These Terms of Use will be made available in PDF format along with the purchased products.
2 - BINDING AGREEMENT
2.1. By purchasing any of the ARQBASE PRODUCTS or SERVICES, the BUYER agrees and is legally bound by the provisions of these Terms of Use.
2.2. If the BUYER disagrees with any clause in these Terms, they must refrain from purchasing ARQBASE PRODUCTS or SERVICES, thereby avoiding legal binding to its terms.
3 - LICENSES OF USE
3.1. The BUYER has the right to use ARQBASE PRODUCTS or SERVICES in their projects and for their personal or academic development.
3.2. It is prohibited to retransmit, distribute, copy, or reproduce, in whole or in part, with or without profit, the material from ARQBASE PRODUCTS and SERVICES without prior and express authorization from the legal representatives, under penalty of compensation for moral and material damages, in addition to legal sanctions.
3.3. Access to products is personal and non-transferable, being exclusively for the BUYER's use, who assumes full responsibility for storage, confidentiality, and misuse by third parties.
4 - DISCLAIMER OF LIABILITY
4.1. The BUYER acknowledges that the performance and/or results of the products may be influenced by various factors, such as the equipment used, the version of the software used to open and edit the provided files, and even the internal settings and/or preferences that the user establishes for the software. In this regard, GORDEEFF ARQUITETURA E TREINAMENTOS LTDA is not responsible for any issues in the operation of the products arising from these factors.
5 - FINAL PROVISIONS
5.1. The BUYER declares, under penalty of law, that they have the legal capacity to accept the terms of this instrument or, in the absence of such capacity, that they are duly represented or assisted by their parents, guardians, legal representatives, or equivalents, who assume responsibility for their actions.
5.2. By making the purchase, the BUYER declares that they have read and fully agree with the terms of use established herein.
5.3. If the BUYER shares the acquired content with third parties or violates any clauses of these Terms of Use, GORDEEFF ARQUITETURA E TREINAMENTOS LTDA reserves the right to suspend access to ARQBASE PRODUCTS or SERVICES without any refund or compensation, and may also take legal action for breach of contract and violation of copyright.
6 - INDUSTRIAL AND INTELLECTUAL PROPERTY RIGHTS
6.1. ARQBASE PRODUCTS or SERVICES are the exclusive property of GORDEEFF ARQUITETURA E TREINAMENTOS LTDA, constituting protected material under national and international intellectual and industrial property laws.
7 - LIFETIME ACCESS
7.1. When the product or course purchased is advertised as being provided with lifetime access, it is understood that the BUYER has the right to use the acquired content as long as GORDEEFF ARQUITETURA E TREINAMENTOS LTDA and its digital platforms remain in regular operation and technically compatible with the necessary conditions for service provision.
7.2. The term “lifetime access” does not mean a guarantee of perpetual operation or an obligation to maintain access through third-party platforms (e.g., Hotmart, streaming services, external servers), nor does it imply a guarantee of eternal availability. Access will be maintained as long as the provision of the service remains technically and economically feasible.
7.3. In the event of permanent unavailability or definitive termination of the platform used to deliver the content, GORDEEFF ARQUITETURA E TREINAMENTOS LTDA undertakes, within its technical and economic possibilities, to adopt at least one of the following measures:
a) Migrate the BUYER’s access to a new members’ platform or equivalent environment;
b) Provide the BUYER with digital copies of the acquired content for secure download;
c) Offer a full or proportional refund if the previous alternatives prove technically or economically unfeasible.
7.4. In the event of the definitive termination of GORDEEFF ARQUITETURA E TREINAMENTOS LTDA’s business activities, the company shall notify BUYERS at least thirty (30) days in advance and implement one of the measures set forth in item 7.3, considering its access obligations fulfilled upon execution of the chosen measure.
7.5. Lifetime access refers exclusively to the content available at the time of purchase. It does not guarantee access to future content, courses, additional products, updates, new modules, mentorships, or bonuses that may be released later, unless expressly stated in the offer or sales page.
7.6. Occasional updates or technical improvements to the material may be offered at the discretion of ARQBASE, without this implying any obligation to include new content or future versions.
